Analysis: Marcellus commission leaves door open on impact fee, pooling

As former Environmental Protection Secretary John Hanger noted, the bulk of the recommendations in the governor’s Marcellus Shale Advisory Commission report “are non-controversial, modest, useful ideas” that should be implemented. However, the two most controversial recommendations — impact fees and pooling — are likely to get most of the attention. Both are couched in creative — some might say evasive — language. The proposal for an “impact fee” has been derided by a wide variety of gas factions — from left-wing environmental groups to Senate Republicans — as too limited.

Seamus McGraw, author of the definitive book on Marcellus, called it “plain boneheaded.” McGraw called the proposal “a capitulation — not to the drillers, because the big ones don’t really object to a severance tax — but the hard ideological Grover Norquist wing of the GOP.”

The problem with the proposed impact fee, they all say, is it’s laser-focused on local impacts with no acknowledgement of a bigger picture. That seemed to be how Lt. Gov. Jim Cawley and several others on the commission wanted it. But the language of the report does, in fact, allow for statewide distribution schemes by the commonwealth.

The majority of impacts the commission deemed “appropriate” for reimbursement were indeed hyper-local — such as increased court costs and local water and sewer extensions — but the commission also put its stamp of approval on three unequivocally statewide schemes for a fee: 3. ”State natural resource agency oversight, permit review and enforcement.”

And after some wrangling, the commission also approved a fourth from environmental groups: “Community-based projects to protect and restore land, wildlife, water resources and outdoor recreation opportunities.”

That could easily encompass “Growing Greener,” the highly successful statewide environmental program begun under former Gov. Tom Ridge and favored by current Senate President Joe Scarnati.

The real problem with the commission’s fee proposal is that it kicks the can down the road on specific costs. It says that a fee should mitigate or offset “the uncompensated portion of demonstrated impacts” and that “any fee should include a correlation between the amount of the fee and costs incurred,” but it does nothing to enumerate those costs.

Praise to Allah for three (3) months I undergo my internship that begins on early February this year till end of April, I finally successfully completed my Industrial training report. For the remaining 3 months more that I have to continue my training in order to complete my course, I pray to Allah hoping my journey is in His bliss. Last but not least I would like to extend my appreciation to my industrial supervisor, Dr. Ir. Selamat Bin Aliman and Ir. Fakhrul Zakee for their advices and patiently guiding me through while I working here as a trainee. Not forgotten for all the staffs working at SBA Consultant I very much appreciate for their entire kindness helping and teaching me when I’m working there. I am very lucky to have such a helpful colleagues and I never felt left out in any situation.             I am entrusted to undergo my industrial training at SBA Consultant for six (6) months before I can complete my subject course in order to graduate. For now I have completed half of the period required for my training. During these 3 months working here I am exposed to many new things which are very valuable for me to learn and carry out with devotion when I face the real world of working in the future. Undergoing for industrial training has become one of the curricular that college student compulsory to attend especially for those who studied at IPTA. The motive of this action is to expose students and let them experience the environment of the real world of working before graduating. It is also to prepare students to face the real challenge and learn how to find solution when problem encountered besides completing the course. This exposure not only will prepare the students but it is also a great opportunity to gain knowledge at industry. Besides that, it can prepare students on how to polish more their soft skill especially on how to communicate with others and learn to do work in a group.
